CHETAN KRISHNASWAMY writes from Bangalore: In one moment of fiery bluster, the venerable old man ripped the synthetic façade enveloping Indian politics asunder, and revealed its true essence.
Not for him the nuanced subtleties in speech, the clipped accent, the dramatic arching of the brow, the elaborate hand-wringing—or even the eloquence hidden in the unspoken word.
Those are best left to “cultured politicians”; the city-bred types harrumphing over Black and Blue Label.
Haradanahalli Doddegowda Deve Gowda, to give the venerable old man his full name, pulls up his panche, sups on ragi balls and soppina saaru, and speaks a mean, belligerent, even bellicose, language.
Gowda’s in-your-face, no-holds-barred style poses a nightmare for erudite analysts, who earn their daily bread deciphering the actions and utterances of smooth, inscrutable politicians.
Gowda’s WYSIWYG approach offers no scope for interpretation.
It is as direct, as coarse, as crass as it can get.
The unrestrained rants of the former prime minister on the current chief minister are in bad taste, no doubt, but spare me the bloody histrionics and indignation, will you?
# In a country where ministers callously stand by and watch a policeman hacked in front of their eyes breathing his last by the way side….
# In a country where 150 of 543 MPs face criminal charges including “human trafficking, immigration rackets, embezzlement, rape and even murder”….
# In a country where politicians take money to ask questions, take money to vote, take money to buy coffins for soldiers or fodder for animals….
In a country, in a State, that is completely desensitised to the average politician’s shenanigans, a sensitive streak suddenly emerges after a lazy Sunday siesta because of a fulltime politician’s abusive language?
Make no mistake, I do not condone Gowda’s diatribe.
But I would not condemn it, either.
India’s politicians deserve each other.
To all but those who have just returned from their year-end trip to Mars, here’s the news: Deve Gowda has always revelled in the politics of antagonism, and the operative word there is always, not antagonism.
Be it with his brother Basave Gowda in Holenarasipur, be it with his bosom buddy Ramakrishna Hegde, be it with his one time trusted aides Siddaramaiah or P.G.R. Sindhia, be it with his kinsman Venkatagiri Gowda, Deve Gowda’s default mode is one of antagonism.
People of Holenarsipur still talk of Gowda’s legendary enmity with the late G. Puttaswamy Gowda, a local Congress politician. I have met every one of these notables at some point or the other and they have all confessed of being stunned by Gowda’s ruthlessness.
He has been intemperate and surly in his interactions even with his confidants. Barring one or two individuals, his coterie is in a state or perpetual churn. Entries and exits happen in swift succession, in keeping with Gowda’s shifting ambitions and volatile moods.
In other words, his outrage with B.S. Yediyurappa is one of a piece.
Gowda has been as unpredictable with the media.
Journalists who imagine themselves to be close to Gowda, suddenly find themselves at sea. If, on one occasion, he is thrusting an indulgent arm around you and addressing you as “brother”, the next day he could simply turn the other way around and say, well, bhosidi maga.
Gowda has always been an interviewer’s nightmare. He can be completely incoherent and scattered, or bitingly caustic or abruptly turn into an inveterate mumbler.
For the hungry journalist, Deve Gowda rarely gives good copy.
On one occasion, sometime in the late 1990s, I traveled to his modest home in Haradanahalli, over 200 kms from Bangalore, had a fabulous lunch with his family, served by his son H.D. Revanna’s wife Bhavani, engaged him for an hour and returned without a story.
It is fortunate that I had a liberal editor in The Week’s T.R. Gopalakrishnan.
On another occasion, while he was the chief minister, his then-press secretary, S.V. Jayasheela Rao, promised me an early-morning “exclusive” at Gowda’s Padmanabhanagar residence. All I got that morning was a disjointed monologue and avarekal uppittu, which was the saving grace.
We might compare him with other former PMs and quibble with Deve Gowda’s choice of words.
We might compare him with other former PMs and let our tongues wag about mountains of moolah.
We might compare him with other former PMs and talk of his gracelessness.
Yet how many would boast of a rousing endorsement from their top bureaucrat?
In his 2004 book, former cabinet secretary T.S.R. Subramaniam says of Gowda:
‘‘On the day I took charge as cabinet secretary, he told me, ‘My sons and my relatives will want to exploit my present position to their pecuniary advantage. They will use their proximity to me, through open and subtle ways, to influence you, and to put pressure on you. I want you to be completely fair and impartial and not oblige them’.’’
Haradanahalli Doddegowda Deve Gowda, India’s 14th Prime Minister, Karnataka’s 14th Chief Minister, who began his career in public life as president of Anjaneya Cooperative Society, Holenarasipura, is will go down history as a bare knuckled, unrelenting fighter .
And at 77 he is all set to release his autobiography, perhaps ready to spout more invectives and tear his critics to shreds. Those who trifle with the volatile Vokkaliga trifle with peril.

You are right about politicians dividing the people on the basis of religion, caste, class etc to take the focus off the real issues.
This problem has become worse because the media is not doing its job. Why?
The media is also obsessed about TRPs and is it is now owned by crony CAPITALISTS. So, the media also reports on silly celebrity stories, and lulls people into sleep. The only investigative journalism they do is of the sex-tape kind because there will be lots of people to watch it. Really, what difference is there between the press in China and the press in India. The press in China are servants of the government. Here, the press are servants of who-ever pays them. We didn’t need a Sainath to show that.
So, but, one could say that given this problem of bad media, it is an opportunity for someone to come forward and form a new decent media group. This is best done by people concerned about the democracy in our country. Donations should be collected from aam-aadmi and a new media group should start.
And, there should be formation of some organisation in India which will help independent candidates in contesting elections.

As one of my childhood friends in B’lore (who happens to be one of those mari-pudharis who do the ‘oiling’ work in Soudha) says it has been an all encompassing spectre of corruption ie from ‘Bicycle’ to ‘Bus’. What ‘Bicycle’ scheme was to Yeddy and Sons, JnNURM driven ‘Bus’ are to R. Ashoka+Jaggesh!

Answer is clear no. Holenarsipura and ramnagara are clear winners compared to any rural constituencties of karnataka. Ramanagara is way ahead of many urban areas.The canals of hemavathy rip through holenarsipura making it a fertile agricultiral area.Revanna’s role in KMF and his contribution to hoLenarsipura and chennaraya patna is very well known.even his detractors do not deny this fact.So as far as their areas are concerned,they have done commendable job.
2) Did he butcher his opposition brutlessly?
Yes, he did. But in politics no one is saint either. Even yedyurappa tried suppressing Basavana gaouda patil yatnal and Eshwarappa and shettar.
DG is very well known for below belt politics. But who cares? almost all of his opponents had to run away from from. He might be seeing defeated now.But seeing politics from RK hegde’s time we never know how he will come back.even at this age he can throw surprises.
3) His usage of words is correct?
Its wrong? But does a weak CM like yeddi who cries every week deserve this.I think he deserves much more.When yeddy openly admitted his weakness by saying he compromised he lost the remaining respect i had in him.
Anyhow by entry of BJP we have seen politics enter a new low. After Dg’s words i think open fight will now become more and more common.

This is a superb piece really! Finally some justice done! In fact there was nothing really all that wrong in DG said. It surely is regrettable but most politician folks do use this language (May be no guts to use them in the media) Yeddy included.
Looking back at some of the most popular and most controversial topics addressed by Churumuri, based on the popular and swift responses, this topic has obviously been a rocker, indeed.
Some of the inputs, especially the reveling ones from folks like Tsubba, Sandhya S, Nrupathunga , Khan and many many others who will actually influence a ray of hope that there are still some intellectuals among the ‘helpless us’ who don’t get diverted from the real common man, farmer or middle class citizen’s issues.
Talking about lively and sometimes revealing feedback, thanks partly to Churumuri’s popularity: it is now well known that some of these feedback/inputs from people (a.k.a alias’s) are actually from either the PAs of the ministers/rivals or the flunkies of the powerful politicians not to mention their black money cohorts, shady real estate/mafia/excise businessmen..etc. Not surprisingly, the list of intellectual contributors most probably includes a few renowned journalists who understandably need to let out genuine steam that is suffocated under their own biased, corrupt management!
Finally to those that think readers or the author are smoking whatever stuff….It’s high time everyone concerned about Karnataka or Kannadiga’s realize the pathetic disaster the state, capital, infra & key cities have become. Our corrupt and crooked politicians are here to stay. All are corrupt indeed but it pays to support the ones who also fight for a genuine cause. Very valid points that you raise.
A CM who admits in public that he has committed lot of follies to remain in power goes without any moralistic trial. Why? Because of the quiver in his voice as he was crying buckets on end? Just because he used the ‘right’ words to convey or confess his misdeeds? Strange indeed are the ways of our fellow travellers.
Then there is the strange case of DG’s rivalry with RK Hegde. As you have pointed out political rivalries are legion and our own Yeddy is certainly not above it. Ofc he might be conducting these shadow wars with a measure of finesse as compared to DG.
But if we fairly assess the history, RK Hegde was para-dropped from centre once the Janata Party’s battle was won in Karnataka. This was Congress style of functioning via high-command. It would be asking too much of DG or any other tall leaders of KAR from JP not to hold any grudge against RK in such a scenario. Well..RK himself wasn’t a great advertisement for probity given the (in)famous phone-tapping scandal and Reva-Jeethu land scandal. But then RK was suave, handsome and media-savvy and thus darling of the middle class. Poor DG misses out on all these counts. Bad for him!

sir ibrahim, thanks for you kind words. but i think it is futile to search for pure beings and a pure state of being. anytime somebody refers to a pure state of being, i now know by instinct that it is a hoax. there is no such thing as a pure state. religion/socialist included. if you or i was a DG or any another politician we would do the same.
only thing that matters is that there is a fair, commonly accepted set of protocols or a level playground that allows competing entities to duke it out. justice comes not from a set of self sacrificing do-gooders but from having a level field that can arbitrate fairly between competing social entities.
Deve Gowda learned from politicians like Ramakrishna Hegde on how to manipulate, exploit and fool people. His expertise is to fool people (especially his collegues in politics) over and over again.

Who was Rk hegde? In 1983 when Congress for first time had no majority, it was S bangarappa, deve gowda and SR bommai fighting for CM’s post.It was Rk hegde who went a s a mediator and landed in CM’s post.
That is the reason that DG and SR bommai carried their enemity against Rk like anything. Bommai was also instumental in getting RK hegde expeled from party.
we all know the famous Phone tapping case of ramakrishna hegde. He was no saint either.But he was soft spoken,dressed well, was eating more sofisticated food than ragi muddhe(dirty to some here) and looked after media people well. He was a identical to today’s SM krishna in all means.
I believe its Devarj arus who was the only CM who is worthy mentioning something here. No nijalingappa or no Rk hegde worth anywhere near Devaraj aras.

Talking about a level playing field the Supreme Court has virtually slapped Dirty for being a gadfly in NICE’s case, twice. I too agree with one and all NICE should build the road and create a few townships–but that is something successive state governments have failed to hold NICE responsible for. Only recently Kamaran’s government tried to crudely cancel the agreement with NICE but Supreme Court whipped Kamaran’s ass and he had to beat a retreat. All this Dirty’s silly tactics will not work. Witness how Supreme Court threw out Shanthibhushan’s motivated PC petition–inspired by URA DumbleBore–was not even admitted!

ಬೆಂಗಳೂರು-ಮೈಸೂರು ನಡುವೆ ಎಕ್ಸ್ಪ್ರೆಸ್ ಕಾರಿಡಾರ್ ಹೆದ್ದಾರಿ ನಿರ್ಮಿಸಲು 1995ರಲ್ಲಿ ಆದ ಒಪ್ಪಂದ ಈಗ ಒಂದು ‘ಅಕ್ರಮ ಸಂತಾನ’. ಒಪ್ಪಂದ ಆದ ಸಮಯದಲ್ಲಿ ಅಸ್ತಿತ್ವದಲ್ಲೇ ಇರದಿದ್ದ ‘ನೈಸ್’ ಸಂಸ್ಥೆ ಈಗ ಎಕ್ಸ್ಪ್ರೆಸ್ ಹೆದ್ದಾರಿ ಯೋಜನೆ ಜಾರಿಗೊಳಿಸುತ್ತಿದ್ದು ಅದನ್ನು ತಮ್ಮ ಶಿಶು ಎಂದು ಒಪ್ಪಿಕೊಳ್ಳಲು ಯಾರೂ ಸಿದ್ಧರಿಲ್ಲ. ‘ದೇವೇಗೌಡರೇ ಸಂಸ್ಥೆಯ ಜತೆಗೆ ಒಪ್ಪಂದ ಮಾಡಿಕೊಂಡವರು ಅವರೇ ಅದಕ್ಕೆ ಜವಾಬ್ದಾರರು’ ಎಂದು 95ರ ನಂತರ ಬಂದ ಬಹುತೇಕ ಸರ್ಕಾರಗಳೆಲ್ಲ ತಮ್ಮ ಹೊಣೆ ಹಾರಿಸಿಕೊಂಡಿವೆ. ಈಗ ದೇವೇಗೌಡರು, ಅದು ತಮ್ಮ ಶಿಶು ಹೌದು ಎಂದು ಮೊದಲ ಬಾರಿಗೆ ಒಪ್ಪಿಕೊಂಡಿದ್ದಾರೆ. ಆದರೆ, ‘ಅದು ದಾರಿ ತಪ್ಪಿದ ಶಿಶು, ಕಳೆದ 15 ವರ್ಷಗಳಲ್ಲಿ ಆ ಶಿಶುವನ್ನು ಯಾರು ಯಾರು ಎತ್ತಿಕೊಂಡರು, ಅದನ್ನು ಹೇಗೆ ದಾರಿ ತಪ್ಪಿಸಿದರು’ ಎಂಬ ಬಗ್ಗೆ ಶ್ವೇತಪತ್ರ ಹೊರಡಿಸಬೇಕು ಎಂದು ಆಗ್ರಹಿಸಿದ್ದಾರೆ.
ಮೂಲ ಒಪ್ಪಂದ ಆದಾಗ ಕೇವಲ 2,000 ಕೋಟಿ ರೂಪಾಯಿ ಮೊತ್ತದ್ದಾಗಿದ್ದ ಈ ಯೋಜನೆ ಈಗ, 30,000 ಕೋಟಿ ರೂಪಾಯಿಗಳ ಯೋಜನೆ ಎನಿಸಿದೆ. ಕಳೆದ ಎಂಟು ಹತ್ತು ವರ್ಷಗಳಲ್ಲಿ ಸ್ಥಿರಾಸ್ತಿ (ರಿಯಲ್ ಎಸ್ಟೇಟ್) ವಲಯದಲ್ಲಿ ಆದ ಬೂಮ್ ಮಾತ್ರ ಇದಕ್ಕೆ ಕಾರಣವಲ್ಲ. ನೈಸ್ ಯೋಜನೆಯ ಮೂಲ ಸ್ವರೂಪದಲ್ಲಿಯೂ ಭಾರಿ ಬದಲಾವಣೆ ಆಗಿದೆ. ಆದರೆ, ಬದಲಾವಣೆ ಸರಿಯಾದ ದಾರಿಯಲ್ಲಿ ಆಗಿದೆಯೇ? ಅಥವಾ 95ರ ನಂತರ ಬಂದ ಸರ್ಕಾರಗಳು ಎಡವಿದವೇ? ಸಾರ್ವಜನಿಕ ಹಿತಾಸಕ್ತಿ ಮರೆತು ಬಿಟ್ಟವೇ? ಅಥವಾ ದೇವೇಗೌಡರೇ ರಾಜಕೀಯ ಇಲ್ಲವೇ ವೈಯಕ್ತಿಕ ಕಾರಣಗಳಿಗಾಗಿ ಯೋಜನೆಯನ್ನು ವಿರೋಧಿಸುತ್ತಿದ್ದಾರೆಯೇ ಎಂಬುದು ಈಗ ಕಾಡುತ್ತಿರುವ ಪ್ರಶ್ನೆ.
1995ರಲ್ಲಿ ಬಾಬಾ ಕಲ್ಯಾಣಿ, ಮೆಸಾಚುಸೆಟ್ಸ್ನ ರಾಜ್ಯಪಾಲ ಹಾಗೂ ಸರ್ಕಾರದ ನಡುವೆ ಬೆಂಗಳೂರು-ಮೈಸೂರು ರಸ್ತೆ ಹೆದ್ದಾರಿ ನಿರ್ಮಾಣಕ್ಕೆ ರುಜು ಆಗಿದ್ದಾಗ ಸರ್ಕಾರ ಹಾಕಿದ್ದ ಷರತ್ತುಗಳು ಇವು : ‘ಬೆಂಗಳೂರು-ಮೈಸೂರು ನಡುವೆ 110 ಕಿ.ಮೀ ಹೆದ್ದಾರಿ ನಿರ್ಮಿಸುವುದಲ್ಲದೇ ಈ ರಸ್ತೆಗೆ ರಾಷ್ಟ್ರೀಯ ಹೆದ್ದಾರಿ ಎನ್.ಎಚ್ 4 ಹಾಗೂ 12ರ ಜತೆಗೆ ಸಂಪರ್ಕ ಕಲ್ಪಿಸುವ 41 ಕಿ.ಮೀ ರಸ್ತೆಯನ್ನೂ ನಿರ್ಮಿಸಬೇಕು. ಇದಕ್ಕಾಗಿ ಚತುಷ್ಪಥ ರಸ್ತೆ ನಿರ್ಮಿಸಬೇಕು. ಅದು ಕಾಂಕ್ರೀಟ್ ರಸ್ತೆ ಆಗಿರಬೇಕು. ಮುಂದೆ ಇದನ್ನು ಷಟ್ಪಥ ರಸ್ತೆಯಾಗಿ ರೂಪಿಸಲು ಅವಕಾಶ ಇರಬೇಕು. ರಸ್ತೆ ನಿರ್ಮಾಣಕ್ಕೆ ಬೇಕಾದ ಸರ್ಕಾರಿ ಮತ್ತು ಖಾಸಗಿ ಜಮೀನನ್ನು ಮಾರುಕಟ್ಟೆ ದರದಲ್ಲಿ ಖರೀದಿಸಬೇಕು.
ಸಂಸ್ಥೆ ಖರೀದಿಸಿದ ರೈತರ ಜಮೀನಿಗೆ ಪರ್ಯಾಯವಾಗಿ ಬೇರೆ ಕಡೆ ಜಮೀನು ಕೊಡಬೇಕು. ಈ ರೈತರ ಕುಟುಂಬದ ಸದಸ್ಯರೊಬ್ಬರಿಗೆ ನೌಕರಿ ಕೊಡಬೇಕು. ಮನೆ ಕಳೆದುಕೊಂಡವರಿಗೆ ಮನೆ ಕಟ್ಟಿಸಿಕೊಡಬೇಕು. ಈ ಯೋಜನೆಯಿಂದ ಸರ್ಕಾರದ ಮೇಲೆ ಯಾವುದೇ ಹೊರೆ ಬೀಳಬಾರದು. ಜಮೀನನ್ನು ಪರಭಾರೆ ಮಾಡಬಾರದು, ಯೋಜನೆ ಪೂರ್ಣಗೊಂಡ ನಂತರ 30 ವರ್ಷಗಳ ಕಾಲ ಸಂಸ್ಥೆಯು ಟೋಲ್ ಸಂಗ್ರಹಿಸಿ ರಸ್ತೆಯನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಬಿಟ್ಟುಕೊಡಬೇಕು. ರಸ್ತೆ ನಿರ್ಮಾಣ ಮಾಡುವ ಸಂಸ್ಥೆ ಹೂಡಿದ ಬಂಡವಾಳಕ್ಕೆ ಕನಿಷ್ಠ ಶೇ 18 ರಿಂದ 20ರಷ್ಟು ಲಾಭ ಬರಬೇಕು ಎಂಬ ದೃಷ್ಟಿಯಿಂದ ಬಿಡದಿ, ರಾಮನಗರ, ಚನ್ನಪಟ್ಟಣ, ಮಂಡ್ಯ ಮತ್ತು ಶ್ರೀರಂಗಪಟ್ಟಣದ ಬಳಿ ಟೌನ್ಶಿಪ್ ನಿರ್ಮಿಸಬಹುದು. 30 ವರ್ಷಗಳ ನಂತರ ಇದರಲ್ಲಿ ಶೇ 60ರಷ್ಟು ಪ್ರದೇಶವನ್ನು ಸರ್ಕಾರಕ್ಕೆ ಬಿಟ್ಟುಕೊಡಬೇಕು.
ಶೇ 40ರಷ್ಟು ಪ್ರದೇಶದಲ್ಲಿ ನಿವೇಶನ / ಮನೆ ನಿರ್ಮಿಸಿ ಮಾರಬಹುದು’. ಆಗ ಈ ಯೋಜನೆಯಡಿ ರಸ್ತೆ ನಿರ್ಮಾಣಕ್ಕಾಗಿ 5,800 ಎಕರೆ ಮತ್ತು ಟೌನ್ಶಿಪ್ ನಿರ್ಮಾಣಕ್ಕೆ 13,000 ಎಕರೆ ಜಮೀನು ಬೇಕು ಎಂದು ಅಂದಾಜು ಮಾಡಲಾಗಿತ್ತು. ಇದಾದ ನಂತರ ಗೌಡರು ಪ್ರಧಾನಿಯಾಗಿ ದೆಹಲಿಗೆ ತೆರಳಿದರು.
ಜೆ.ಎಚ್.ಪಟೇಲರು ಮುಖ್ಯಮಂತ್ರಿಯಾಗಿದ್ದ ಅವಧಿಯಲ್ಲಿ ನೈಸ್ ಸಂಸ್ಥೆ ಅಸ್ತಿತ್ವಕ್ಕೆ ಬಂದು ಈ ಯೋಜನೆಯನ್ನು ನಿರ್ವಹಿಸಲು ಮುಂದೆ ಬಂತು. ಆಗ ನೈಸ್ ಸಂಸ್ಥೆ ಜತೆಗೆ ಮಾಡಿಕೊಂಡ ಒಪ್ಪಂದದಲ್ಲಿ ಸಂಸ್ಥೆಗೆ ಕೊಡಬೇಕಾದ ಭೂಮಿಯ ಪ್ರಮಾಣವನ್ನು 20,193 ಎಕರೆಗೆ ಏರಿಸಲಾಯಿತು. ಇದರಲ್ಲಿ 6,999 ಎಕರೆ ಪ್ರದೇಶವನ್ನು ರಸ್ತೆ ನಿರ್ಮಾಣಕ್ಕೆ ಉಳಿದ ಭೂಮಿಯನ್ನು ಟೌನ್ಶಿಪ್ ನಿರ್ಮಾಣಕ್ಕೆ ಎಂದು ನಿಗದಿ ಮಾಡಲಾಯಿತು. ಆದರೆ, ಸರ್ಕಾರಿ ಜಮೀನನ್ನು ಮಾರುಕಟ್ಟೆ ದರದಲ್ಲಿ ಖರೀದಿಸಬೇಕು ಎಂಬ ಷರತ್ತನ್ನು ಸಡಿಲಿಸಿ ಒಂದು ಎಕರೆ ಜಮೀನಿಗೆ ಒಂದು ವರ್ಷಕ್ಕೆ ಹತ್ತು ರೂಪಾಯಿಯಂತೆ ಗುತ್ತಿಗೆ ಕೊಡಬೇಕು ಎಂದು ಒಪ್ಪಂದ ಮಾಡಿಕೊಳ್ಳಲಾಯಿತು!
ಪಟೇಲರ ನಂತರ ಎಸ್.ಎಂ.ಕೃಷ್ಣ ಸರ್ಕಾರ ಅಧಿಕಾರಕ್ಕೆ ಬಂದಾಗ, ನೈಸ್ ಸಂಸ್ಥೆಗೆ ರೈತರ ಭೂಮಿ ಖರೀದಿ ಮಾಡಲು ಹತ್ತು ಕೋಟಿ ರೂಪಾಯಿ ಠೇವಣಿ ಇಡಬೇಕು ಎಂದು ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಅಭಿವೃದ್ಧಿ ಮಂಡಳಿ, ಸಂಸ್ಥೆಗೆ ತಿಳಿಸಿತು. ‘ಅಷ್ಟು ಹಣ ನಮ್ಮ ಬಳಿ ಇಲ್ಲ. ಸಾಲ ಎತ್ತಲು ಸರ್ಕಾರದ ಭೂಮಿಯನ್ನು ಅಡವು ಇಡಲು ಅನುಮತಿ ಕೊಡಿ’ ಎಂದು ನೈಸ್ ಸಂಸ್ಥೆ ಸರ್ಕಾರಕ್ಕೆ ಕೇಳಿಕೊಂಡಿತು. ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಒಂದು ಒಪ್ಪಂದವೂ ಆಯಿತು. ಇದಕ್ಕೆ ಪೂರಕವಾಗಿ ತನಗೆ ಹಂಚಿಕೆಯಾಗಿದ್ದ 1,800 ಎಕರೆ ಜಮೀನನ್ನು ಹಾಗೂ ಖಾಸಗಿಯವರಿಂದ ಖರೀದಿಸಿದ್ದ ಜಮೀನನ್ನು ಅಡವು ಇಡಲು ಖಾತ್ರಿ ನಿಂತುಕೊಳ್ಳುವುದಕ್ಕೆ ಪುರಾವೆಯಾಗಿ ‘ಲೆಟರ್ ಆಫ್ ಕಂಫರ್ಟ್’ ಅನ್ನೂ ಕೃಷ್ಣ ಸರ್ಕಾರ ಸಂಸ್ಥೆಗೆ ನೀಡಿತು. ಆ ಮೂಲಕ, ಮೂಲ ಒಪ್ಪಂದದಲ್ಲಿ ಇದ್ದ, ‘ಸರ್ಕಾರದ ಮೇಲೆ ಯಾವುದೇ ಹೊರೆ ಬೀಳಬಾರದು’ ಎಂಬ ಷರತ್ತು ಕಡೆಗಣಿತವಾಯಿತು.
ನೈಸ್ ಸಂಸ್ಥೆ ಈ ಜಮೀನನ್ನು ಐ.ಸಿ.ಐ.ಸಿ.ಐ ಬ್ಯಾಂಕಿಗೆ ಅಡವು ಇಟ್ಟು 150 ಕೋಟಿ ರೂಪಾಯಿ ಸಾಲ ಎತ್ತಿತು.
ಜತೆಗೆ ಕೃಷ್ಣ ಸರ್ಕಾರ ಅಧಿಕಾರದಲ್ಲಿ ಇದ್ದಾಗಲೇ ಈ ರಸ್ತೆ ಯೋಜನೆಗೆ ಕೊಟ್ಟಿರುವ ಸರ್ಕಾರಿ / ಖಾಸಗಿ ಜಮೀನನ್ನು ಪರಭಾರೆ ಮಾಡಲು ಮತ್ತು ರಸ್ತೆ ಯೋಜನೆಯನ್ನು ಪದೇ ಪದೇ ಬದಲಿಸಲು ಅವಕಾಶ ಸಿಕ್ಕಿತು. ಹಾಗೂ ಡಿ.ಕೆ.ಶಿವಕುಮಾರ್ ಅಧ್ಯಕ್ಷರಾಗಿದ್ದ ಬಿಎಂಐಸಿ ಯೋಜನಾ ಪ್ರಾಧಿಕಾರ 1.53 ಲಕ್ಷ ಎಕರೆ ಪ್ರದೇಶವನ್ನು ಸ್ವಾಧೀನಪಡಿಸಿಕೊಳ್ಳಲು ಅಧಿಸೂಚನೆಯನ್ನೂ ಹೊರಡಿಸಿತು. ಒಟ್ಟು ಯೋಜನೆಗೆ ಬೇಕಾಗಿದ್ದ 20,193 ಎಕರೆ ಜಮೀನಿಗೆ ಹೋಲಿಸಿದಾಗ 1.53 ಲಕ್ಷ ಎಕರೆ ಜಮೀನಿಗೆ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ್ದು ಶಂಕೆ ಮೂಡಿಸಿತು.
ದೇವೇಗೌಡರು, ಈಗ ‘ಮದ್ದೂರಿನವರು, ಕನಕಪುರದವರು ಏನೇನು ಮಾಡಿದ್ದಾರೆ, ಅದು ಹೊರಗೆ ಬರಲಿ’ ಎಂದು ಹೇಳುತ್ತಿರುವುದು ಈ ಅಂಶಗಳನ್ನು ಗಮನದಲ್ಲಿ ಇಟ್ಟುಕೊಂಡೇ ಇರಬೇಕು. ನೈಸ್ ಸಂಸ್ಥೆ, ರಸ್ತೆ ಅಭಿವೃದ್ಧಿ ಮಾಡುತ್ತಲೇ ಸ್ಥಿರಾಸ್ತಿ ವಹಿವಾಟಿನಲ್ಲಿ ತೊಡಗಿದಾಗ ನಿವೃತ್ತ ಎಂಜಿನಿಯರ್ ಸೋಮಶೇಖರರೆಡ್ಡಿ ಎಂಬುವರು ರಾಜ್ಯ ಹೈಕೋರ್ಟಿನಲ್ಲಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದರು. ಈ ಅರ್ಜಿಯ ಮೇಲೆ ಹೈಕೋರ್ಟ್ ತೀರ್ಪು ನೀಡಿ ಪಟೇಲ್ ಸರ್ಕಾರದ ಅವಧಿಯಲ್ಲಿ ಆದ ಒಪ್ಪಂದದ ಚೌಕಟ್ಟಿನಲ್ಲಿಯೇ ಯೋಜನೆ ಜಾರಿಯಾಗಬೇಕು ಎಂದು ಆದೇಶಿಸಿತು. ಈ ತೀರ್ಪನ್ನು ನೈಸ್ ಸಂಸ್ಥೆ ಸುಪ್ರೀಂ ಕೋರ್ಟಿನಲ್ಲಿ ಪ್ರಶ್ನೆ ಮಾಡಿದಾಗ ಹೈಕೋರ್ಟ್ ತೀರ್ಪನ್ನೇ ಅದು ಕೂಡ ಎತ್ತಿ ಹಿಡಿಯಿತು.
ಆದರೆ, ಸರ್ಕಾರಗಳು ತಮ್ಮ ಯೋಜನೆಗೆ ಜಮೀನು ನೀಡಲು ವಿಳಂಬ ಮಾಡಿದಾಗ, ನೈಸ್ ಸಂಸ್ಥೆ ಅಧಿಕಾರಿಗಳ ವಿರುದ್ಧ ನ್ಯಾಯಾಂಗ ನಿಂದನೆ ಪ್ರಕರಣ ಹೂಡಿತು. ವಿಳಂಬಕ್ಕೆ ದೇವೇಗೌಡ ಕುಟುಂಬ ಕಾರಣ ಎಂದೂ ಅದು ದೂರಿತು. ಈ ಪ್ರಕರಣ ಇನ್ನೂ ಇತ್ಯರ್ಥವಾಗಬೇಕಿದೆ. ಈ ಯೋಜನೆಯಿಂದ ರೈತರಿಗೆ ಅನ್ಯಾಯವಾಗುತ್ತಿದೆ ಎಂದು ಭಾವಿಸಿದ ನಿವೃತ್ತ ನ್ಯಾಯಮೂರ್ತಿ ರಾಮಾ ಜೋಯಿಸ್ ಅವರು ಕುಮಾರಸ್ವಾಮಿ ನೇತೃತ್ವದ ಸಮ್ಮಿಶ್ರ ಸರ್ಕಾರಕ್ಕೆ ಒಂದು ಪ್ರಸ್ತಾವ ಸಲ್ಲಿಸಿ ಇದುವರೆಗೆ ಈ ಯೋಜನೆಗೆ ಆಗಿರುವ ವೆಚ್ಚವನ್ನು ನೈಸ್ ಸಂಸ್ಥೆಗೆ ಸರ್ಕಾರವೇ ಭರಿಸಿಕೊಟ್ಟು ತಾನೇ ಅನುಷ್ಠಾನ ಮಾಡಬೇಕು, ಈ ಬಗ್ಗೆ ಒಂದು ಮಸೂದೆ ಮಂಡಿಸಬೇಕು ಎಂದು ಶಿಫಾರಸು ಮಾಡಿದರು.
ಆದರೆ, ಈ ಮಸೂದೆ ಬಗ್ಗೆ ಸಂಪುಟದಲ್ಲಿ ಚರ್ಚೆಯಾಗುವಾಗ ಪಂಚತಾರಾ ಹೋಟೆಲ್ಗಳಲ್ಲಿ ಬಿಜೆಪಿ ಶಾಸಕರ ಸಭೆ ನಡೆದು ಸಂಪುಟ ಸಭೆಯಲ್ಲಿ ಯಾರೂ ಭಾಗವಹಿಸಲಿಲ್ಲ. ಹಾಗಿದ್ದೂ, ರಸ್ತೆ ನಿರ್ಮಾಣಕ್ಕೆ ಕುಮಾರಸ್ವಾಮಿ ಜಾಗತಿಕ ಟೆಂಡರ್ ಕರೆಯಲು ತೀರ್ಮಾನಿಸಿದರು. ನೈಸ್ ಯೋಜನೆ ಕುರಿತು ವಿಧಾನಮಂಡಲದಲ್ಲಿ ನಡೆದ ಸುದೀರ್ಘ ಚರ್ಚೆಯ ಫಲಶ್ರುತಿ ಎಂಬಂತೆ ಕುಮಾರಸ್ವಾಮಿ ಸರ್ಕಾರ ಬಿ.ಸಿ.ಪಟೇಲ್ ಆಯೋಗ ನೇಮಿಸಿ ವಿಚಾರಣೆಗೆ ಆದೇಶಿಸಿತು. ಅದಕ್ಕೆ ನೈಸ್ ಸಂಸ್ಥೆ ಸುಪ್ರೀಂ ಕೋರ್ಟಿನಿಂದ ತಡೆಯಾಜ್ಞೆ ತಂದಿತು. ನಂತರ ಯಡಿಯೂರಪ್ಪ ಈ ಪ್ರಸ್ತಾವ ಕೈ ಬಿಟ್ಟರು.
2002ರಲ್ಲಿ ಕನಕಪುರ ಲೋಕಸಭೆ ಚುನಾವಣೆಗೆ ಸ್ಪರ್ಧಿಸಿ ಗೆದ್ದ ನಂತರ ನೈಸ್ ಸಂಸ್ಥೆಯ ವಿರುದ್ಧ ಸಮರ ಸಾರಿದ ದೇವೇಗೌಡರು, ನೈಸ್ ಸಂಸ್ಥೆ ಸಲ್ಲಿಸಿದ ಅರ್ಜಿಗಳ ಮೇಲೆ ನ್ಯಾಯಾಲಯ ನೀಡುತ್ತಿರುವ ಆದೇಶಗಳು ‘ಸೃಷ್ಟಿತ ದಾಖಲೆಗಳ ಆಧಾರದ್ದು’ ಎಂದು ಒಂದು ಪುಸ್ತಕವನ್ನೇ ಬರೆದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಮತ್ತು ಹೈಕೋರ್ಟಿನ ನ್ಯಾಯಮೂರ್ತಿಗಳಿಗೆ ಕಳುಹಿಸಿಕೊಟ್ಟರು. ಈ ಪುಸ್ತಕ ಕಳುಹಿಸಿದ ರೀತಿಯನ್ನು ಇಷ್ಟಪಡದಿದ್ದರೂ ಹೈಕೋರ್ಟ್ ಅದನ್ನು ಒಂದು ಸಾರ್ವಜನಿಕ ಹಿತಾಸಕ್ತಿಯ ಅರ್ಜಿ ಎಂದು ಪರಿಗಣಿಸಿ ಈ ಬಗ್ಗೆ ಲೋಕಾಯುಕ್ತರಿಂದ ತನಿಖೆ ಮಾಡಿಸಬೇಕು ಎಂದು ಆದೇಶಿಸಿತು. ಅದಕ್ಕೂ ನೈಸ್ ಸಂಸ್ಥೆ ಸುಪ್ರೀಂ ಕೋರ್ಟಿನಿಂದ ತಡೆಯಾಜ್ಞೆ ತಂದಿತು. ಈ ಮಧ್ಯೆ, ದೇವೇಗೌಡರು ನ್ಯಾಯಾಂಗ ನಿಂದನೆ ಅರ್ಜಿಯಲ್ಲಿ ತಾವು ಇಂಪ್ಲೀಡ್ ಆಗಲು ಬಯಸಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದರು. ಸಾಹಿತಿ ಅನಂತಮೂರ್ತಿಯವರೂ ಈ ಯೋಜನೆಯಿಂದ ರೈತರಿಗೆ ಅನ್ಯಾಯವಾಗುತ್ತಿದೆ ಎಂದು ದೂರಿ ಇಂಪ್ಲೀಡ್ ಆಗಲು ಬಯಸಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದ್ದಾರೆ.
ಇದೀಗ ಅಡ್ವೋಕೇಟ್ ಜನರಲ್ ಅಶೋಕ ಹಾರ್ನಹಳ್ಳಿಯವರು 2004ರ ಓಡಿಪಿ (ಕೃಷ್ಣ ಸರ್ಕಾರದಲ್ಲಿ ಆದ ಒಪ್ಪಂದ) ಅನುಸಾರ ಯೋಜನೆಗೆ ಜಮೀನು ಕೊಡಲು ಸಿದ್ಧ ಎಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟಿಗೆ ತಿಳಿಸಿದ್ದಾರೆ. ಅವರು 97ರ (ಪಟೇಲ ಸರ್ಕಾರ) ಮೂಲ ಚೌಕಟ್ಟು ಆಧಾರದ ಮೇಲೆ ಜಮೀನು ಕೊಡುತ್ತೇವೆ ಎಂದು ಹೇಳಬೇಕಿತ್ತು ಎಂಬುದು ದೇವೇಗೌಡರ ವಾದ. ರಾಜ್ಯ ಸರ್ಕಾರದ ಲೋಕೋಪಯೋಗಿ ಇಲಾಖೆ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿಗಳ ವಾದವೂ ಅದೇ ಇದ್ದಂತಿದೆ. 2004ರ ಓಡಿಪಿ ಪ್ರಕಾರ ಜಮೀನು ಕೊಟ್ಟರೆ ಅದು ದೇವೇಗೌಡರು ಆರೋಪಿಸುತ್ತಿರುವಂತೆ ರಸ್ತೆ ನಿರ್ಮಾಣ ಬಿಟ್ಟು ಫಿಲ್ಮ ಸಿಟಿಗಳ ನಿರ್ಮಾಣಕ್ಕೆ ಅವಕಾಶ ಕಲ್ಪಿಸಬಹುದು ಎಂಬ ಶಂಕೆ ಇದೆ. ಹಾರ್ನಹಳ್ಳಿಯವರು ಹೇಳಿದ್ದನ್ನು ಹಿಂದಿನ ಅಡ್ವೋಕೇಟ್ ಜನರಲ್ ಉದಯ್ ಹೊಳ್ಳ ಹೇಳಲು ಒಪ್ಪಲಿಲ್ಲವೇ? ಅದಕ್ಕೇ ಅವರು ರಾಜೀನಾಮೆ ಕೊಟ್ಟು ಹೊರಟು ಹೋದರೇ?
ಸೋಮಶೇಖರ ರೆಡ್ಡಿ ಪ್ರಕರಣದಲ್ಲಿ ಹೈಕೋರ್ಟ್ ಆದೇಶವನ್ನು ಎತ್ತಿ ಹಿಡಿದಿರುವ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನ್ಯಾಯಾಂಗ ನಿಂದನೆ, ಅನಂತಮೂರ್ತಿ ಮತ್ತು ದೇವೇಗೌಡರ ಇಂಪ್ಲೀಡ್ ಅರ್ಜಿಗಳ ಮೇಲೆ ತೀರ್ಮಾನ ಕೊಡಬೇಕಿದೆ. ದೇವೇಗೌಡರು, ತಮ್ಮ ಎಲ್ಲ ಪ್ರತಿಷ್ಠೆಯನ್ನು ಪಣಕ್ಕೆ ಇಟ್ಟು ಹೋರಾಟ ಮಾಡುತ್ತಿದ್ದಾರೆ. ತಾಳ್ಮೆಯನ್ನೂ ಕಳೆದುಕೊಳ್ಳುತ್ತಿದ್ದಾರೆ. ಯಡಿಯೂರಪ್ಪನವರು ಪ್ರಧಾನಿ ಬಳಿಯೇ ಚರ್ಚೆಗೆ ಹೋಗೋಣ ಎನ್ನುತ್ತಿದ್ದಾರೆ (ಏಕೆ? ಕೃಷ್ಣ ಅವರನ್ನು ಸಿಗಿಸಿ ಹಾಕಲೇ?!). ಈ ಆರೋಪ, ಪ್ರತ್ಯಾರೋಪಗಳಲ್ಲಿ ವಸ್ತುಸ್ಥಿತಿ ಏನು ಎಂಬುದು ಯಾರಿಗೂ ಗೊತ್ತಾಗುತ್ತಿಲ್ಲ. 15 ವರ್ಷಗಳ ಕಾಲ ಒಂದು ಯೋಜನೆ ಎಳೆದಾಡಿದರೆ ಏನೆಲ್ಲ ಗೊಂದಲ ಆಗಬೇಕೋ ಈಗ ಅದೇ ಆಗಿದೆ. ದೇವೇಗೌಡರಿಗೆ ನೈಸ್ ಯೋಜನೆ ಬಗ್ಗೆ ಪೂರ್ವಗ್ರಹ ಇದೆ ಎಂದು ಬೇಕಾದರೆ ಅಂದುಕೊಳ್ಳೋಣ. ಅನಂತಮೂರ್ತಿ, ರಾಮಾ ಜೋಯಿಸರಿಗೆ ಯಾವ ಪೂರ್ವಗ್ರಹ?

i think you have the wrong the wrong assesment of the scope and purport of supreme court cases and rulings. A SC judgement on any case in this matter, is not to be mistaken for an audit of the project in its entirety. or as enquiry or as proof of its validity as a project as a whole. the SC cases are on particular aspects of the project only.
please consider, if even a gowda cannot bring the project to heel. what are the chances sundry small little landowners can do?

Indeed it is the proof of validity of the whole project! Just consider the Cauvery Water dispute: till the SC stepped in and gave an adverse judgement against Karnataka (during SMK’s regime) we were very sure our rights were being safeguarded. Supreme Court’s active interest in the matter was a jolt to Karnataka. We are still fighting the case and Supreme Court did an audit of the entire dispute spanning over 150 years. So we can take it that with NICE, Supreme Court will do a thorough audit although partial judgements will appear to help along the case.
My point about Supreme Court judgement is this: why are you giving too much importance to someone like Dirty? Do you think a commercial project can be stopped because someone like Dirty thinks it is not up to the standard? The problem is of credibility. WHat credibility does Dirty command?!! WHat is wrong with a toll road? Why did Dirty and supporters go anal when NICE started a small stretch of toll road damaging its pay-go booths and infrastructure?
Like I said earlier, Dirty is just an obscurantist humbug. What NICE does with extra land should be handled by the government–hence a fact of cases against NICE even from Ramajois, URA and others.
